Privacy Policy

This policy explains what personal data SparkVoid (sparkvoid.com) collects, what we use it for, who we share it with, how long we keep it and how you can exercise your rights. It describes what the service does today, in plain language. Purchase conditions are in the Terms of Service.

1. Who is responsible

The controller of your data is Vicente San Silvestre Chacon, domiciled at San Isidro de San Ramón, Alajuela, Costa Rica (calle frente a la fábrica de puertas Mapro), who runs SparkVoid.

2. What data we collect

We only collect what we need to create and deliver your gift:

  • Account data: when you sign in with Google we receive your email address and an account identifier and, if Google shares them, your name and profile picture, which we only show in your user menu.
  • Gift content: your answers to the form (for example, the names of the recipient and the sender, memories, dedication, instructions, ages and dates), the photos you upload and the song lyrics. Depending on the occasion, it may include data about minors (such as a child’s age or a baby’s date of birth) or about people who have passed away.
  • Email addresses: yours, to send you the receipt and the gift, and, if you provide it, the recipient’s.
  • Order data: amount, currency, payment status and the Creem transaction identifier. We never receive or store your card details: you enter them directly on Creem’s payment page.
  • Photo metadata: we store photos exactly as you upload them, with any metadata they carry (for example, date or location, if your phone added it). We do not read or use it.
  • Technical data: our infrastructure providers process your IP address and basic request data to serve the site and protect it from abuse. We do not use it to identify you or for advertising.

3. What we use it for

  • Creating your gift: composing the song, editing the video and publishing them on the gift’s private page.
  • Delivering it and talking to you: sending you the receipt and the gift-ready notice, emailing the gift to the recipient if you gave us their address, and answering your questions.
  • Processing the payment with Creem and handling refund requests.
  • Protecting the service: preventing fraud and abuse, and keeping it running.
  • Meeting legal, accounting and tax obligations.

We do not sell your data, use it for advertising or build marketing profiles.

4. Who we share it with

We only share data with the providers we need to run the service, and only what each one needs:

  • Google (Gemini API, Lyria model): receives a text summary of your answers (names, memories, dedication and instructions) to compose the song’s lyrics, music and vocals.
  • ElevenLabs: backup service to compose the music and to sync the lyrics with the audio. It receives your answers as text, or the song’s audio and lyrics.
  • Groq: checks the spelling of your texts before payment, scores the quality of the lyrics and, as a backup, syncs the lyrics with the audio. It receives your texts, the lyrics or the audio.
  • Amazon Web Services (AWS): hosts the site, database and files, sends the emails, handles sign-in and detects where faces are in your photos (Amazon Rekognition) only to frame them in the video. We do not identify people or store biometric data.
  • Creem: processes the payment as Merchant of Record. It receives your email, the amount and the order identifier.
  • Google (sign-in and fonts): handles sign-in with your Google account; the site’s fonts are also loaded from Google Fonts, which receives your IP address.

Your photos are never sent to Google, ElevenLabs or Groq: they are only processed inside our AWS infrastructure.

We may also disclose data when a competent authority requires it under the law.

5. International transfers

Our providers process data mainly in the United States. By using the service, you consent to your data being transferred outside Costa Rica for the purposes of this policy, under the safeguards those providers offer.

6. How long we keep it

  • Unpaid gifts: the draft order is deleted after 24 hours and its photos after 7 days.
  • Paid gifts: the answers, photos, song, video and thumbnail are kept for 90 days from payment and then deleted automatically.
  • You can delete a gift earlier from “My gifts”; that immediately erases its answers, photos, song and video.
  • Payment records: we keep each order’s data (amount, date, status and email) for as long as accounting and tax law requires.
  • Server logs: deleted after 30 days.
  • Account: your sign-in data is kept while you have an account; you can ask us to delete it.

7. Your rights

You can ask us at any time to access, correct or delete your data, to object to its processing, or to withdraw your consent, under Costa Rica’s Law No. 8968 on the Protection of Individuals with regard to the Processing of their Personal Data. If you live elsewhere, you can also exercise the equivalent rights your law grants you (for example, the GDPR in the European Union).

Write to lema017@gmail.com from your account’s email address. We reply within 3 business days and resolve within the legal deadlines. Account deletion is done manually, on request.

If you believe we did not handle your request properly, you can contact Costa Rica’s data protection agency (PRODHAB).

8. Minors

You must be at least 18 years old to buy on SparkVoid. The service is not directed at minors.

If you include data or photos of minors in a gift, you confirm that you are their parent or guardian, or that you have their permission. We only use that data to create and deliver the gift.

9. Security

We use encrypted connections (HTTPS), private storage and temporary download links. Every gift has a link that cannot be guessed and, depending on the protection you choose, an extra key in the link or a PIN that locks after several failed attempts. No system is infallible, but we take reasonable measures to protect your data.

10. Cookies and local storage

We do not use advertising cookies or analytics or tracking tools.

For the site to work, your browser stores locally (localStorage) your language, the draft of the gift you are creating, the order in progress and your session. You can clear them from your browser settings.

11. Changes to this policy

If we change this policy, we will publish the new version on this page with its update date. If the change is significant, we will highlight it on the site.
