Terms of Service

1. Who we are

SparkVoid is a service run by Vicente San Silvestre Chacon, domiciled at San Isidro de San Ramón, Alajuela, Costa Rica (calle frente a la fábrica de puertas Mapro). Contact: lema017@gmail.com or WhatsApp +506 8661 4106.

2. The service

SparkVoid creates personalized digital gifts: an original song and a video made with the photos you upload, based on your answers to the form.

The song’s lyrics, melody and vocals are generated with third-party artificial intelligence tools. The video is edited from your photos: we do not generate images.

The gift is delivered on a private page, with a link and a QR code to share it. It is usually ready within minutes; the maximum delivery time is 48 hours from payment confirmation.

3. Account and minimum age

To buy, you must sign in with a Google account and be at least 18 years old. You are responsible for your account’s activity and for the accuracy of the data you enter.

4. Price and payment

The price is the one shown on the site and in the order summary before you pay, in US dollars. It is a one-time payment: there are no subscriptions or recurring charges.

Payments are processed by Creem, which acts as the Merchant of Record for the transaction. Creem may add the taxes that apply in your country, and the charge appears on your statement as “CREEM.IO* STORE”. The payment is also subject to the conditions Creem shows on its checkout page.

We never receive or store your card details.

5. Immediate production

Every gift is digital content made to order, and we start creating it as soon as the payment is confirmed. By paying, you agree to that immediate start and acknowledge that, to the extent the applicable law allows, you can no longer withdraw from the purchase, except in the cases listed under Refunds.

6. Refunds

We refund the payment when the gift cannot be used because of a system failure or an error on our side, after reviewing the case.

Covered cases:

• The gift was not delivered (for example, it ended in the “Failed” state) and we could not fix it.
• The video or the song does not play, or was delivered incomplete or damaged.
• The result does not match the data you gave because of an error on our side (for example, a different name, other photos or another language).
• The link or the PIN does not work and we do not fix it within a reasonable time.
• The same order was charged twice.

Not covered:

• Personal taste: the style, voice, melody or wording of the lyrics.
• Mistakes in the data you entered (for example, a misspelled name).
• Changing your mind after paying, or the recipient not liking it.
• The gift having expired after the 90-day storage period.

How to request it: write to lema017@gmail.com within 14 calendar days of the gift’s delivery (or of the charge, if it was never delivered). Include your account email, the affected gift and evidence of the failure: screenshots or a screen recording and a description. If the gift shows as “Failed” in your account, no evidence is needed; we can see it in our system.

What happens next: we reply within 3 business days. We first try to fix the problem, for example by generating the gift again. If the failure is confirmed and cannot be fixed, we refund the full amount paid through Creem to the same payment method. How long it takes to show up depends on your bank.

Nothing above limits the rights that consumer law grants you and that cannot be waived.

7. Delivery, access and availability

At checkout you choose how the gift page is protected: public, secure link or PIN. You are responsible for sharing the link, the QR code or the PIN only with the people you want.

The gift is available for 90 days from payment. When it expires, the gift and its files are permanently deleted, so we recommend downloading the video and the song.

8. Your content

You are responsible for the photos and texts you give us. You confirm that you have the right to use them and that the people who appear in the photos (or their parents or guardians, if they are minors) agree.

You grant us a limited, non-exclusive, free license to use that content only to create, store and deliver your gift. We do not publish it or use it for advertising without your permission.

9. Acceptable use

You may not use SparkVoid to create content that:

• Is sexual, explicit or sexually suggestive, or sexualizes minors in any way.
• Promotes hatred, discrimination, violence or harassment.
• Defames, threatens or humiliates a person, or impersonates someone.
• Uses other people’s photos, names or data without their consent.
• Infringes copyright, trademarks or other third-party rights.
• Is illegal or promotes illegal activities.

We may reject or cancel an order that breaks these rules (if we have not produced it yet, we refund the payment) and delete an already delivered gift that breaks them. To report inappropriate content, write to lema017@gmail.com.

10. Using your gift

The gift is for personal use: you can watch it, download it and share it with anyone, including on social media, as long as it is not for commercial purposes. You may not resell it or use it in advertising or commercial products.

11. AI-generated content

Because the song is generated with artificial intelligence, every result is unique and may vary: the style, melody, performance or the pronunciation of some names may not be exactly what you imagined. These variations are not a system failure unless they make the gift unusable under Refunds.

The song and the video are based on the data you give; review it before paying.

12. Limitation of liability

We provide the service with reasonable care, but we do not guarantee it will run without interruptions or errors. To the extent the law allows, our total liability for an order is limited to the amount you paid for it, and we are not liable for indirect damages or for how third parties use the link to a gift you shared.

13. Suspension

We may suspend or close an account that breaks these terms, tries to harm the service or uses it fraudulently.

14. Governing law

These terms are governed by the laws of the Republic of Costa Rica, and any dispute will be submitted to its competent courts. This does not limit the rights granted to you by Costa Rica’s consumer protection law (Law No. 7472) or by the law of your country of residence.

15. Changes to these terms

We may update these terms. The version in force is the one published on this page with its date, and each order is governed by the terms in force when it was paid.
